1. Scope

These Terms of Use apply to the website battlecraft.eu (“Website”) and all related features, including but not limited to user accounts, profiles, forum, blog/news, comments, private messages, support tickets including uploads, the shop, and all related BattleCraft services.

The Website and related BattleCraft services are operated by Edis Schmuck and Jan Heinrich (“we”, “us”, “our”).

By using the Website, the shop, or any related BattleCraft service, you agree to these Terms of Use.

2. Purpose and services

The Website supports the BattleCraft Minecraft server network, community, shop, support system, and related online services.

We may change, extend, restrict, suspend, or discontinue any part of the Website, the BattleCraft network, individual servers, game modes, features, or related services at any time where necessary, including but not limited to maintenance, security, technical, balancing, legal, operational, or community-related reasons.

We aim to provide a stable and enjoyable service, but we do not guarantee permanent or uninterrupted availability of the Website, the BattleCraft network, individual servers, game modes, features, or related services.

3. User accounts and security

Some features require an account, including but not limited to forum access, support tickets, user profiles, private messages, and shop-related features.

You must provide accurate information where required and keep your login credentials secure. You are responsible for activities carried out through your account, unless the misuse was not caused by you.

You must not:

- create accounts using bots, scripts, or automation,
- attempt to bypass restrictions, bans, security systems, or access controls,
- exploit bugs, vulnerabilities, or unintended behavior,
- misuse the Website, the shop, support systems, or any related BattleCraft services,
- impersonate other users, staff members, or third parties,
- provide false or misleading information in connection with account, support, or shop features.

We may suspend, restrict, or terminate accounts in cases of abuse, security risks, rule violations, fraud, chargebacks, or misuse of BattleCraft systems.

4. Community conduct and moderation

You must comply with applicable laws, these Terms of Use, and our community/server rules while using community features, including but not limited to forum posts, comments, support tickets, private messages, profiles, uploads, and in-game related services.

Prohibited behavior includes but is not limited to:

- harassment, insults, hate speech, threats, or discriminatory behavior,
- illegal content or content promoting illegal activity,
- spam, flooding, trolling, or disruptive behavior,
- fraud, scams, phishing, or unauthorized advertising,
- publishing personal data of others without permission,
- uploading malicious files, harmful links, or unsafe content,
- exploiting, manipulating, or attempting to bypass Website, shop, or server systems,
- encouraging others to violate rules, laws, or these Terms of Use.

We may moderate content and take appropriate action, including but not limited to removing content, issuing warnings, restricting features, suspending accounts, terminating accounts, or excluding users from BattleCraft services.

There is no entitlement to keep content published or to continue using community features after rule violations or misuse.

5. User-generated content and uploads

You may submit content, including but not limited to text, images, forum posts, comments, support ticket messages, logs, screenshots, and other files.

You confirm that you have the necessary rights to submit such content and that your content does not violate applicable laws, third-party rights, privacy rights, intellectual property rights, or these Terms of Use.

You grant us a non-exclusive, worldwide, royalty-free right to store, display, process, reproduce, and use your submitted content to the extent necessary for operating and providing the Website, community features, support systems, moderation, security, and related BattleCraft services.

Examples include displaying forum posts, processing support tickets, reviewing uploaded screenshots or logs, investigating rule violations, and maintaining the security and functionality of our services.

We may remove or restrict user-generated content if it violates these Terms of Use, our rules, applicable law, third-party rights, or if removal is necessary for moderation, security, technical, legal, or operational reasons.

6. Shop, digital goods, delivery, refunds, and virtual currency

The shop is available through our platform LeaderOS, and checkout/payment processing is handled via Tebex.

Digital goods and virtual items, including but not limited to Gems, ranks, crates, keys, cosmetics, permissions, boosts, or other in-game benefits, are provided exclusively for use within the BattleCraft Minecraft server network.

Gems are a virtual in-game currency for BattleCraft only. Gems are not legal tender, not electronic money, not a bank balance, and do not represent any real-world monetary value. Gems cannot be paid out, exchanged for real money, sold, transferred outside BattleCraft, or redeemed outside the BattleCraft network.

By purchasing Gems or other digital goods, the user receives a limited, revocable, non-exclusive, non-transferable right to use the purchased digital goods within the BattleCraft network, subject to these Terms of Use and our applicable server rules. No ownership right in any digital good, virtual currency, server feature, account feature, or in-game benefit is transferred to the user.

The availability and usability of digital goods, including Gems, ranks, crates, keys, cosmetics, permissions, boosts, or other in-game benefits, depends on the continued operation and availability of the BattleCraft network, individual servers, game modes, plugins, databases, and related services.

We may change, balance, restrict, replace, remove, reset, or discontinue digital goods, virtual items, features, game modes, servers, or services where necessary for technical, security, balancing, operational, legal, or community-related reasons.

If the BattleCraft network, individual servers, game modes, or related services are permanently discontinued, the ability to use Gems or other digital goods may end in whole or in part. In such a case, unused Gems or other digital goods do not create a claim for payout, refund, replacement, conversion, transfer, or compensation, unless mandatory legal rights provide otherwise.

Delivery is typically automated in-game. The user is responsible for entering correct account and player information where required. We are not responsible for failed or delayed delivery caused by incorrect information provided by the user, temporary server unavailability, maintenance, third-party service issues, or technical disruptions outside our reasonable control.

Refunds are reviewed on a case-by-case basis. Once digital goods have been delivered, credited, activated, or otherwise made available, refunds are generally excluded to the extent permitted by law.

Fraudulent chargebacks, payment disputes, abuse, or attempts to manipulate the shop, payment process, delivery systems, accounts, or in-game benefits may result in account restrictions, removal of benefits, negative balance adjustments, permanent exclusion from BattleCraft services, or other appropriate measures.

For EU/EEA consumers: For digital content or digital services, the statutory right of withdrawal may expire once performance has begun, if the customer has expressly agreed that performance begins before the withdrawal period ends and has acknowledged that they thereby lose their right of withdrawal, where applicable in the checkout flow.

7. Availability and liability

We aim for high availability and stable operation, but we cannot guarantee uninterrupted, error-free, or permanent availability of the Website, BattleCraft network, individual servers, game modes, databases, shop systems, or related services.

Availability may be affected by maintenance, updates, technical issues, DDoS attacks, hosting provider issues, software errors, security incidents, third-party service outages, force majeure, or other circumstances outside our reasonable control.

To the extent permitted by law:

- We are liable for intent and gross negligence.
- For minor negligence, we are liable only for breaches of essential contractual obligations and only for foreseeable, typical damages.
- Essential contractual obligations are obligations whose fulfillment is necessary for the proper performance of the service and on whose compliance the user may regularly rely.

Nothing in these Terms of Use limits liability where liability cannot legally be limited, including liability for injury to life, body, or health, mandatory statutory liability, or liability under applicable consumer protection laws.

8. External services and links

The Website and related BattleCraft services may link to or integrate external services, including but not limited to Discord, Tebex, LeaderOS, Minecraft-related services, server status tools, payment providers, social media platforms, or other third-party services.

External providers are responsible for their own content, services, terms, privacy policies, payment processing, availability, and security.

We are not responsible for the content, availability, behavior, or policies of external services unless required by law.

9. Changes to these Terms

We may update these Terms of Use as necessary, including but not limited to legal changes, new features, technical changes, shop changes, security requirements, operational changes, or changes to BattleCraft services.

The version published on the Website is the current version.

If changes are material, we may provide reasonable notice where appropriate. Continued use of the Website, shop, or related BattleCraft services after changes become effective may be considered acceptance of the updated Terms of Use, to the extent permitted by law.

10. Governing law and severability

German law applies, to the extent permitted by law.

If the user is a consumer and mandatory consumer protection laws of the user’s country of residence provide stronger protection, those mandatory rights remain unaffected.

If any provision of these Terms of Use is invalid, unlawful, or unenforceable, the remaining provisions remain effective. The invalid provision shall be replaced, to the extent permitted by law, by a valid provision that comes closest to the economic and legal purpose of the original provision.
